PART II – PRIVACY & DATA USE POLICY

This Privacy & Data Use Policy explains how PAISA TAX LLC collects, uses, shares, and protects information when you use the Service. It forms part of the Agreement.

By creating an Account or using the Service, you acknowledge that you have read and understood this Policy and consent to the practices described, as permitted by Applicable Law.


1. Scope

This Policy applies to:

  • Information we collect from or about you when you access or use our web and mobile applications and related services
  • Information we receive from third parties in connection with your use of the Service

This Policy does not apply to third-party websites or services that are not controlled by PaisaTax, even if you access them via links in the Service.

2. Information We Collect

We may collect the following categories of information, which can include Personal Information and Tax Information:

2.1 Identifiers and Contact Information

  • Full name
  • Mailing and physical address
  • Email address
  • Phone number
  • Account username or identifiers
  • Government-issued identifiers (e.g., SSN, ITIN, EIN) where required for tax preparation and filing

2.2 Tax and Financial Information

  • Income and wage information (e.g., W-2, 1099, K-1)
  • Deductions, credits, and expenses (e.g., mortgage interest, education, medical, charitable contributions)
  • Filing status, marital status, and dependent information
  • Prior-year tax return data
  • Bank account and routing numbers for refunds or tax payments
  • Other financial and tax-related details you provide for planning or preparation

2.3 Documents and Uploaded Content

  • Scanned or uploaded tax forms, receipts, and financial records
  • Photos or images of tax documents
  • Data extracted from such documents through automated or manual processes

2.4 Device and Technical Information

  • IP address
  • Browser type and version
  • Device type, operating system, and device identifiers
  • Log data, including pages or screens viewed, actions taken, timestamps, and error logs

2.5 Usage and Interaction Data

  • How you interact with the Service (e.g., which features you use, steps completed)
  • Clickstream and navigation data
  • Interaction with the AI Assistant and Licensed Tax Preparer Services (subject to applicable confidentiality and legal requirements)

2.6 Communications and Support

  • Messages, emails, or chat logs with our support team or tax professionals
  • Video session metadata and, where applicable, recordings (if we notify you and/or obtain your consent as required by law)
  • Feedback, survey responses, and reviews

2.7 Inferences

Inferences derived from the information above to improve our services, detect fraud, and tailor the user experience, subject to Applicable Law and appropriate safeguards.

3. How We Collect Information

We collect information:

3.1 Directly from You

  • When you create or update an Account
  • When you input data into the Service or upload documents
  • When you communicate with us, the AI Assistant, or Licensed Tax Preparer Services
  • When you respond to surveys or provide feedback

3.2 Automatically

  • Through cookies, web beacons, pixels, and similar technologies
  • Through server logs and analytics tools that record interactions with the Service

3.3 From Third Parties

  • From Third-Party Service Providers (e.g., identity verification, payment processors, secure communication providers)
  • From employers, payroll processors, or financial institutions, where you authorize data import
  • From public or commercially available sources, where permitted by law

4. How We Use Your Information

We use your information for the following purposes, to the extent permitted by Applicable Law:

4.1 Provide and Operate the Service

  • Prepare, calculate, and file your tax returns
  • Generate tax forms through the Proprietary Algorithm
  • Facilitate communications with the AI Assistant and Licensed Tax Preparer Services
  • Process payments for any Service Fees
  • Maintain and administer your Account

4.2 Customer Support and Communications

  • Respond to your questions, requests, and support tickets
  • Assist you in completing and filing your tax returns
  • Provide notices about return status, deadlines, and account activity

4.3 Improvement and Development

  • Analyze usage and performance of the Service to improve features and user experience
  • Train and refine algorithms, including the AI Assistant and Proprietary Algorithm, using de-identified, aggregated, or otherwise appropriately protected data where feasible
  • Develop new tools and offerings related to tax preparation and financial services

4.4 Security, Fraud Prevention, and Legal Compliance

  • Detect, investigate, and help prevent fraud, abuse, or security threats
  • Protect the integrity and security of our systems and data
  • Comply with tax, regulatory, and other legal obligations
  • Maintain records for audit, accounting, and compliance purposes

4.5 Service-Related Communications

  • Send you confirmations, receipts, and notices related to tax filings and account changes
  • Provide updates about this Agreement and our policies
  • Send service announcements or messages regarding availability, security, or functionality

4.6 Marketing and Product Information (Limited)

  • With your consent where required, send you information about new features, products, or services that may be relevant to you
  • Allow you to manage your marketing preferences, including opting out of certain communications

We do not sell your Tax Information for advertising purposes.

5. How We Share Your Information

We may share your information in the following situations:

5.1 With Tax Authorities

  • With the IRS and applicable state or local tax authorities to file or transmit your tax returns or other forms you authorize
  • To respond to lawful requests or inquiries from tax authorities, as required by law

5.2 With Third-Party Service Providers

We may share information with trusted providers that perform services on our behalf, such as:

  • Cloud hosting and storage
  • Secure user authentication and identity management
  • Data encryption and key management
  • Payment processing
  • Document scanning and data extraction
  • Secure video and chat communication services
  • Analytics, performance monitoring, and support infrastructure

These providers are contractually obligated to protect your information and to use it only to perform services for PaisaTax.

5.3 With Licensed Tax Preparers

  • With human tax professionals engaged by PaisaTax for the purpose of providing Licensed Tax Preparer Services to you
  • These professionals are bound by confidentiality and applicable professional obligations

5.4 Within Our Corporate Group

With affiliates or subsidiaries of PAISA TAX LLC, where applicable, for purposes consistent with this Policy, such as operations, compliance, security, and product improvement.

5.5 Business Transfers

In connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business or assets, your information may be transferred to another entity, subject to appropriate confidentiality and legal protections.

5.6 Legal and Safety

  • To comply with subpoenas, court orders, or other legal processes
  • To protect the rights, property, or safety of PaisaTax, our users, or the public
  • To detect, prevent, or respond to fraud, security, or technical issues

5.7 With Your Consent

  • In any other way we describe when you provide the information
  • When you explicitly consent to additional sharing or use

6. Your Choices and Rights

Depending on your location and Applicable Law, you may have certain rights regarding your Personal Information:

6.1 Access and Portability

You may request access to certain Personal Information we hold about you and, where feasible, obtain a copy in a commonly used format.

6.2 Correction

You may request that we correct or update inaccurate or incomplete Personal Information.

6.3 Deletion

You may request deletion of certain Personal Information, subject to our obligations to retain data as required by tax, accounting, and other laws (for example, to meet IRS retention rules).

6.4 Marketing Preferences

You may opt out of receiving marketing emails by using the unsubscribe link in those emails or by contacting us.

We may still send you non-marketing communications, such as those related to your tax filings, account, or legal notices.

6.5 State-Specific Privacy Rights

Residents of certain U.S. states may have additional rights under state privacy laws (for example, rights to know, delete, or limit certain uses of Personal Information). Where such laws apply, we will honor those rights consistent with Applicable Law. We will not discriminate against you for exercising your privacy rights.

To exercise any of these rights, please use the contact information in Section 11.

7. Data Retention

We retain Personal Information and Tax Information for as long as reasonably necessary to:

  • Provide the Service and fulfill the purposes described in this Policy
  • Comply with tax, legal, and regulatory obligations, including IRS and state retention requirements (which may require retention of certain tax records for at least seven (7) years, or longer in some cases)
  • Resolve disputes and enforce our agreements
  • Maintain business and financial records

When information is no longer needed for these purposes, we will delete, de-identify, or aggregate it, subject to Applicable Law and our internal policies.

8. Security

We implement administrative, technical, and physical safeguards designed to protect your information from unauthorized access, use, disclosure, alteration, or destruction. These measures may include:

  • Encryption of data in transit (e.g., HTTPS/TLS)
  • Encryption of data at rest using managed key services
  • Secure user authentication and authorization controls
  • Segregated and access-controlled databases
  • Logging, monitoring, and other protective controls on our infrastructure
  • Secure communication systems for video and chat within the Service

We strive to align our security practices with applicable IRS and regulatory guidelines regarding taxpayer data protection. However, no system or transmission method is completely secure. While we work to protect your information, we cannot guarantee absolute security. If we become aware of a security incident that affects your Personal Information, we will take steps to investigate and, where required by law, notify you and relevant authorities.

9. Children’s Privacy

The Service is not intended for children under the age of 13, and we do not knowingly collect Personal Information from children under 13 without appropriate consent. If we learn that we have collected Personal Information from a child under 13 without proper consent, we will take steps to delete that information as required by law.

If you believe a child has provided us information, please contact us using the information in Section 11.

10. International Users

The Service is intended for individuals filing U.S. tax returns and is operated from the United States. If you access or use the Service from outside the United States, you understand and agree that:

  • Your information will be transferred to, stored in, and processed in the United States
  • U.S. data protection laws may differ from those in your country

12. Changes to this Privacy & Data Use Policy

We may update this Policy from time to time. If we make material changes, we will provide notice, such as:

  • Posting an updated version within the Service; and/or
  • Sending a notice to the email address associated with your Account

Your continued use of the Service after the effective date of an updated Policy constitutes your acceptance of the changes.
